1. Introduction

These Terms of Service (“Terms”) govern the use of services provided by Rishi M. Mahabir – Trinidad & Tobago Licensed Land Surveyor (“we,” “our,” or “us”) in connection with land surveying and related professional services within Trinidad and Tobago.

By engaging our services or using this website, you agree to these Terms.


2. Scope of Services

We provide professional land surveying services, which may include but are not limited to:

  • Boundary Surveys

  • Topographic Surveys

  • Construction Layout & Staking

  • Subdivision Surveys

  • As-Built Surveys

  • Site Mapping and Survey Consultation

All services are performed in accordance with applicable laws, professional standards, and regulatory requirements of Trinidad and Tobago.


3. Professional Standards & Compliance

Where applicable, survey services requiring licensure will be conducted by or under the supervision of a properly qualified and registered land surveyor in accordance with the laws and regulatory framework of Trinidad and Tobago.

Clients are responsible for ensuring that all required planning approvals, building permits, and governmental consents (including Town and Country Planning approvals and Municipal Corporation permits where applicable) are obtained prior to construction or development.


4. Client Responsibilities

The client agrees to:

  • Provide accurate property information and documentation

  • Grant reasonable site access

  • Inform us of any known boundary disputes

  • Disclose underground utilities or hazards, if known

  • Ensure that the site is safe and suitable for survey operations, including compliance with all applicable health and safety requirements
  • Be fully responsible for the safety and security of the Land Surveyor, his representative(s), and employees while on site

If, in our professional judgment, site conditions are unsafe or pose a risk to personnel or equipment, we reserve the right to suspend or terminate work immediately. In such circumstances, the client shall be responsible for payment of the full day’s work already scheduled or commenced. Any subsequent return to site will be subject to additional charges, including remobilization and rescheduling fees.

Delays caused by restricted access, incomplete information, or unsafe conditions may affect project timelines.


5. Fees and Payment Terms

All fees will be outlined in a written or verbal quotation or agreement prior to commencement of work.

Unless otherwise agreed:

  • A deposit may be required before scheduling

  • Final payment is due upon completion or delivery of survey documents

  • Late payments may incur additional charges

All pricing is quoted in Trinidad and Tobago Dollars (TTD) unless otherwise stated.


6. Deliverables

Survey plans and related documents are prepared for the specific purpose agreed upon at the time of engagement.

Deliverables may not be reused, altered, or relied upon for other purposes without our written consent.

Digital copies are provided for convenience. Official signed and stamped documents, where required, will serve as the authoritative record.


7. Limitations of Liability

While we exercise reasonable care and professional diligence, surveying involves interpretation of historical records, field conditions, and existing markers.

To the fullest extent permitted by law:

  • We are not responsible for undisclosed encroachments, hidden boundary conflicts, or third-party claims not evident at the time of survey.

  • Liability for any claim arising from our services shall be limited to the value of the fees paid for the specific service in question.


8. Force Majeure

We shall not be liable for delays caused by circumstances beyond our control, including but not limited to:

  • Adverse weather or environmental conditions that, in our professional judgment, make survey operations unsafe or risk damage to survey equipment, including water damage
  • Governmental delays

  • Natural disasters

  • Utility disruptions

  • Civil disturbances


9. Intellectual Property

All survey drawings, reports, and documents remain the intellectual property of  YADEV ENGINEERING AND SURVEYING and/or Rishi Mohan Mahabir until full payment is received.

Clients are granted a limited license to use the deliverables solely for the intended project purpose.


10. Dispute Resolution

These Terms shall be governed by the laws of Trinidad and Tobago.

In the event of any dispute, claim, or complaint arising out of or relating to the services, the parties agree to first attempt to resolve the matter in good faith before pursuing legal remedies through the courts of Trinidad and Tobago or submitting a complaint to the Land Survey Board of Trinidad and Tobago.
